These Terms of Service (“Terms”) govern your use of FreeGPT.IM at https://freegpt.im (the “Service”). By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old, or the minimum age required in your jurisdiction, to use the Service. If you are under 18, you must have the permission of a parent or legal guardian.
2. The Service
The Service lets you generate images using OpenAI’s GPT Image 2 model (and compatible upstream providers) based on prompts and reference images you submit. Availability, speed, daily limits, and supported regions may change without notice. We may temporarily throttle or suspend the Service to prevent abuse.
3. Acceptable use
You agree not to use the Service to:
- Generate content that is unlawful, infringing, defamatory, or harassing.
- Generate sexual content involving minors, non-consensual intimate imagery, or content that sexualises real identifiable people without consent.
- Generate content that violates OpenAI’s usage policies for image generation, including but not limited to content that promotes violence, self-harm, illegal activity, or targeted harassment.
- Generate content designed to deceive or defraud (for example, election misinformation, fabricated official documents, or identity impersonation).
- Circumvent rate limits, human verification, or other abuse-prevention measures, or attempt to access the Service other than through the interface we provide.
- Scrape, resell, or redistribute the Service or its output in bulk, or use it to train competing models.
We may remove content, terminate access, and cooperate with law enforcement where we reasonably believe these rules have been violated.
4. Your content and ownership
You retain whatever rights you have in the prompts and reference images you submit. By submitting them you grant us a limited, worldwide, royalty-free licence to transmit them to our upstream model provider for the sole purpose of fulfilling your generation request.
Generated images are produced by a third-party model. Rights in model outputs are governed by the OpenAI terms and the usage policy for GPT Image 2 in force at the time of generation. You are responsible for checking that any commercial use is permitted.
Before each free generation, you must explicitly confirm permission for that task’s prompt and generated images to be stored and displayed in public examples or galleries. We record the confirmation time and consent version. This does not include reference images, uploaded originals, account details or email addresses. Free tasks without this confirmation, including older tasks, are not newly added to public collections. Paid generation records and images are not publicly displayed and require sign-in to the owning account for access. This permission does not apply to all tasks merely because an account has a subscription.
5. No warranty
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, non-infringement, or that output will be accurate, safe, or appropriate. AI models can produce unexpected, biased, or factually incorrect results. Do not rely on generated images for medical, legal, financial, or safety-critical decisions.
6. Limitation of liability
To the maximum extent permitted by law, FreeGPT.IM and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or business opportunities, arising out of or related to your use of the Service. Our aggregate liability for any claim related to the Service is limited to US$50 or the amount you have paid us in the past 12 months (whichever is greater); since the Service is free, this will typically be US$50.
7. Indemnity
You agree to defend and indemnify FreeGPT.IM from and against any claims, damages, and expenses arising from your use of the Service, the content you submit, or your breach of these Terms.
8. Third-party services
The Service integrates third parties including Cloudflare (security, CDN), OpenAI (model provider), and Google (advertising, analytics). Their terms and privacy practices apply to their respective services.
9. Termination
We may suspend or terminate your access to the Service at any time, for any reason, without notice, including where we believe you have violated these Terms or the Acceptable Use rules above.
10. Changes
We may update these Terms. Material changes will be reflected in the “Last updated” date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
11. Governing law
These Terms are governed by the laws of the jurisdiction in which the operator of FreeGPT.IM is based, without regard to conflict-of-laws principles. To the extent permitted by law, disputes will be resolved in the courts of that jurisdiction.
